Justice prohibits Bank of Brazil to collect emission rate billet Autor: Agência Brasil - Justiça
The Bank of Brazil (BB) is forbidden by the courts to charge fee for issuing dockets. The decision of the second instance is the Court of Rio Grande do Sul (TJRS), but worth it for the whole country and can only be overturned by the Supreme Court (STF).
In addition to no longer being able to charge, the bank will have to swap dockets held by holders other exempt tariffs. The institution was also obliged to publish the decision in the newspapers and make $ 2 million in the Fund for the Defense of Diffuse, operated by the Ministry of Justice, as compensation for failing collective consumer rights.
According to Judge Charles Cini Marchionatti, the 20th Civil Chamber of TJRS, the charge for the issuance of the ticket is unfair because it transfers to the account holder operating costs which should be made to the financial institution. The Bank of Brazil had already been convicted in the first instance.
Authorship of the Public Defender of Rio Grande do Sul, who filed class action in court after customer complaints, the lawsuit alleged that the charges to be imposed on the issuing bank bills was illegal based on the Code of Consumer Protection and a Resolution 2009 of the National Monetary Council (CMN).
Also participated in the trial the judges Ruben Duarte and José Glênio Wasserstein Hekman, who accompanied Marchionatti vote, rapporteur of the case. Brazil sought by the Agency, the Bank of Brazil reported that awaits the publication of the judgment to assess appropriate legal measures.
