House approves burden of defeat in the Labour Court Autor: TRT 4ª Região
With the withdrawal of 33 deputies to feature Application 7506/2013, by Deputy Amauri Teixeira (PT-BA), was approved by the House of Representatives, the burden of defeat in the Labour Court. The appeal signed by 62 MPs (number 110/11), had been hampering the assessment conclusively Project.
The Draft Law No. 3392, 2004, authored by former deputy governor at Paraná and labor lawyer Clair Flora Martins will now be sent directly to the Senate. In addition to the burden of defeat, the project considers necessary the action of the attorney in the Labor Court. The bill amends Article 791 of the Labor Code, the fee shall be arbitrated between 10% and 20% of the sentence and the Treasury will also have to pay when they lose the case.
The achievement is a victory of the partnership between the Brazilian Association of Labour Lawyers (ABRAT) and the Federal Council of OAB.
The president of ABRAT, Antônio Gonçalves Fabrício Matos points out that the decision should be celebrated by all lawyers, since from now there will be an equal treatment to professionals in the labor courts.
Matos also shows that this is an old flag of the ABRAT struggle that began with the former president Clair Flora Martins, and nearly 10 years after it becomes reality, thanks to the mobilization of the class.
