Recently, the Bar Association of Brazil succeeded by the House of Representatives, the overthrow of Appeal 110/2011 of the Bill 3.392/2004, which mandates the actions of the attorney in labor and fixed parameters for attorney's fees in Labor Court, which has been seen as a great victory by the entity.
In practice, the bill, which still must be reviewed by the Senate, will extend to all the lawyers acting in the Labour Court the right to receive the burden of defeat, or fees for successfully defending the interests of his client, which today is restricted to the number of professionals who have slender credentials union.
This fact should be celebrated effectively by OAB, however, must be viewed with caution by employers. This is because, today, the "cost" of the vast majority of labor claims are not computed spending the legal fees of the employee, which will occur.
Ie labor disputes should be even more expensive for companies and other employers, gaining even more important to develop effective preventive work to avoid or at least reduce, the convictions in the Labor Court.
